These Terms and Conditions ("Terms") govern your use of the Design Spaces Care website and your engagement with our home improvement services. By accessing our website or scheduling services, you agree to be bound by these Terms.

Service Agreements

All home improvement services are provided pursuant to a separate written service agreement between you and Design Spaces Care or its authorized subcontractors. These Terms supplement but do not replace the specific terms of your service agreement. In the event of a conflict, the service agreement terms shall prevail.

Estimates

All estimates provided by Design Spaces Care are based on the information available at the time of assessment and are valid for 30 days unless otherwise stated. Estimates are not guaranteed final prices and may be adjusted due to unforeseen conditions, changes in scope, material price fluctuations, or code compliance requirements discovered during the project. Any changes exceeding 10% of the original estimate will require your written approval before proceeding.

Scheduling

Project start dates are estimates and may be adjusted based on material availability, weather conditions, permit processing times, and project sequencing. Design Spaces Care will make reasonable efforts to adhere to agreed-upon schedules and will communicate any changes promptly. We are not liable for delays caused by factors beyond our reasonable control.

Payments

Payment terms are specified in your service agreement. Unless otherwise stated, a deposit of 30-50% is required upon project commencement, with progress payments due at specified milestones and final payment due upon satisfactory completion. Late payments may incur a fee of 1.5% per month on the outstanding balance. We accept checks, credit cards, ACH transfers, and financing through approved lending partners.

Warranties

Design Spaces Care provides a workmanship warranty of one year from the date of substantial completion for all installation services, unless otherwise specified in writing. Manufacturer warranties on materials, fixtures, and appliances are passed through to the homeowner and vary by product. Warranty claims must be reported in writing within the warranty period. Warranties do not cover damage caused by misuse, negligence, unauthorized modifications, or natural disasters.

Limitation of Liability

To the maximum extent permitted by applicable law, Design Spaces Care shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services. Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the theory of liability.

All content on this website, including text, graphics, logos, images, and software, is the property of Design Spaces Care or its licensors and is protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any website content without our prior written consent.

User Responsibilities

You agree to provide accurate information when requesting services, ensure reasonable access to your property for our personnel, obtain any required homeowner association approvals, and maintain your property in a manner that does not damage our work after completion. You are responsible for ensuring that your property complies with all applicable zoning, building codes, and permit requirements prior to project commencement.

Governing Law

These Terms and any disputes arising from our services shall be governed by and construed in accordance with the laws of the Commonwealth of USA, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the state or federal courts located in USA. You consent to the personal jurisdiction of such courts.
